Innovation Patents Granted a Last Minute Reprieve

We are pleased to report that the Australian government plans to abolish innovation patents has been taken off the table for the time being at least. When the Intellectual Property Law Amendment Bill was introduced into parliament on 28 March the section dealing with the abolition of the innovation patent was omitted. The Government has agreed to obtain a better understanding of the needs of Australian SME’S before making such a major change to the regime for protecting innovation.
Many patent attorneys and IP lawyers in Australia have argued assiduously for the retention of the system in recent months and this result represents a satisfying result.
